Our Property and Real Estate Department provides legal support to project developers and investors on infrastructure and construction, estate planning, property conveyancing, procurement and securitization as private equity. We provide coherent and commercially sound advice to our clients on the legal and regulatory aspects of real estate development.
The Firm specifically:-
- Assists developers in procuring various approvals e.g. Approvals from the County Government, NEMA, NCA, KCAA, Change of User and any other necessary approval.
- If the project is being financed, we will assist in the negotiations with the Financier, the registration of the Transfer and the Charge.
- Preparation of the Construction Contract with the Contractor and other initial contracts such as the excavation contract, and contracts with other professionals.
- Structuring of the entire project.
- Preparation of the standard agreements to be issued to the Purchasers such as; booking form, offer letter, agreement for sale, home owners rules, next of kin forms, and any other agreement that may be applicable.
- Incorporation of the project’s management company (if need be) and the company secretarial work that will be incidental to its incorporation such as drafting the articles of association, allotment of shares, issuing share certificates etc.
- Preparation and registration of the Sub-Lease and General care for the project at all times.
